F-1 Reinstatement

A F-1 student may lose his or her F-1 status under certain circumstances, sometimes not due to the student’s own fault, and in that case become “out of status.”  It can leads to unwanted consequences.  The student can not continue study, can not have practical training, or any other benefits of F-1 status, and cannot apply change of status to any other non-immigrant status in the United States, such as changing to H-1B for employment after graduation.

There are many reasons that a student can lose his or her status.  Common reasons for losing F-1 student status include attendance issues, unsatisfactory grades, missing registration deadlines, . . . etc.  The school may discontinue the student’s study one or more of the above or other reasons, and then the student loses his or her F-1 status.  Once the student learns that his or her status is lost, prompt actions need to be taken to reinstate the status.

The procedure of reinstatement should be followed for the students who lost F-1 status to reinstate it, but there are conditions before filing it.  The student who becomes out-of-status may be able to reinstate his or her F-1 status if :

  • The student is currently enrolled or intend to enroll in a full-time course study;
  • The student can establish that the violation of status resulted from circumstances beyond his or her control;
  • The student has not engaged in unauthorized employment;
  • The out-of-status is not more than 5 months;
  • The student can has sufficient financial resources to pursue a full-time course study;
  • The student does not have a history of repeated violations of F-1 status;
  • The student is not deportable from the US on any other grounds.
